Abstract

(Regulatory) Impact assessment is a key segment of the so-called Better Regulation Agenda in the European Union and serves as a tool for designing and evaluating EU policies and regulations in a way that they achieve their goals in the most efficient and effective manner possible. Better regulation should ensure an open and transparent decision-making process, citizens and key actors participation in the policy-making process, ensure that decisions and actions are based on evidence and understanding of their implications, and finally contribute to reducing or maintaining at the minimum level of legislative burden for companies, citizens and public administration in general. Bosnia and Herzegovina, as a country with a long-term strategic objective that is reflected in EU membership, must also meet certain conditions on its Euro-integration path, one of which is certainly the reform of public administration. One segment of public administration reform includes the area of policy creation and regulation. In this paper, the author will give a brief overview of the fundamental requirements of this reform area, outline the fundamental characteristics of the drafting of regulations in the institutions of Bosnia and Herzegovina, explain what constitutes an assessment of the impact of regulations, and how it intends to introduce this instrument into the process of drafting legislation in the institutions of Bosnia and Herzegovina. In the concluding considerations, the author will express his views on the need to improve the process of drafting regulations in the institutions of Bosnia and Herzegovina in terms of introducing tools and reaching standards advocated by the European Commission and SIGMA.
