Abstract

Democratic society is comprehensive term which is mostly described in European documents as pluralism, tolerance, broadmindedness and freedom of expression. Every field of state activities should be under Parliamentary scrutiny, including defence, security and intelligence sector. The Parliament ensure legality and democratic oversight of responsibilities. Effective Parliamentary oversight should be done in transparent and responsible manner. However, it sholud be stressed, that parliamentary oveersight is a new phenomenon even in the western democracies. According to that, parliamentary control over security sector presupose the manner of effective protection of security sector without violation of human rights and foundamental freedoms. The best way of effective democratic control over national security as legitimate aim is proportionality beetwen state action and the protection of human rights. In Bosnia and Herzegovina exist two Commities for parliamentary control over national security which are Joint Committee on Defence and Security of Bosnia and Herzegovina considers and monitors the implementation of the security and defence policy of BiH, monitors the work and considers reports from the Standing Commite on Military Matters BiH Ministry of Defence, BiH Ministry of Security and other executive bodies dealing with defence and security, and the other one is Joint Security and Intelligence Commitee on Supervision of the work of Intelligence and Security Agency of BiH that supervises the lawulness of.
